Cool Mediators Foundation (Dutch: Stichting Cool Mediators, Eerste Atjehstraat 174/2 1094 KX Amsterdam) is a non-profit organization registered with the Amsterdam Chamber of Commerce, registration #: 34293444.



Terms and Conditions of Use of the Cool Mediators Platform

Effective as of: March 20, 2010

The Cool Mediators discussion platform is a web application developed by the Cool Mediators Foundation (Stichting Cool Mediators), registered in Amsterdam, The Netherlands. All rights of software, method, concept and design, and related rights are reserved by the Cool Mediators Foundation, and may not be used, copied or distributed in any form by any third party without the express permission of the Cool Mediators Foundation, unless explicitly indicated by means of a public license.

By registering and obtaining an account at Cool Mediators website or web-based software application in the form of embedded widget, You as the User agree to the Terms & Conditions for the use of Cool Mediators. These Terms & Conditions are updated on a regular basis.



General Rules of the Conduct for the Cool Mediators Discussion Platform:

- Your postings should not contain messages and expressions of offensive or discriminating nature.

- You postings can not contain or promote any illegal content and materials which are prohibited by public law;

- Your postings should not contain materials which you are not eligible or authorized to use and disseminate.

- Your postings should not contain advertisement.

- You actions should not be in anyway damaging for the Cool Mediators platform or/and its other users.

If your posting/s or/and action/s violate the rules of conduct declared above, it will be removed from the web site and your membership can be terminated by either Cool Mediators or by channel editors of the Cool Mediators Discussion Platform.



Your Content

The materials which you would like to publish via the Cool Mediators discussion platform, whether it is text, images, video, sound, will retain the proprietary rights specified by you, provided you are eligible to do so. No claims regarding ownership, modification, or further dissemination of your materials on behalf of the Cool Mediators Foundation www.coolmediators.net will be made.

Any action which concerns your materials will be executed only in accordance to your permission, which will be requested prior to it, except in cases where the content of your published materials violates the rules of conduct declared in the Rules of Conduct at the Cool Mediators website www.coolmediators.net/terms.jsp (see the Rules of Conduct above), or where it is required by legally authorized third parties in accordance with the public law in applicable jurisdiction.

In case of violation of one or more rules of conduct, your materials will be removed from the web site without prior notification.

We request users to assume their own responsibility for compliance with authorship, ownership, copyright, and other intellectual property rights and public laws regarding the materials they submit via the Cool Mediators discussion platform.

If you submit your own materials, for the use of which your retain all necessary rights, you can specify yourself under which conditions you would like others to use your materials.

If you wish to submit materials, for the use of which you do not retain the required rights, please make sure that the rights of the author or copyright owner are not violated, or hat you have permission to use these materials. In case we receive a complaint regarding unauthorized use of information materials, we retain the right for ourselves to remove those materials from the web site without prior notification to the person who submitted them in the first place.

The Cool Mediators organization assumes no responsibility for the content published by the project participants via the Cool Mediators discussion platform.



Content and Ownership

All content on our website(s) is owned by the Cool Mediators Foundation or others. Any person is hereby authorized to view information and content found on our website(s) provided that:
1. All published content including but not limited to information, products, models, methods, procedures, frameworks, software, code, intellectual property, technologies, descriptions, documents, pricing and content are intended for informational purposes only.
2. Authorization for directly or indirectly accessing our servers, websites, content including but not limited to information, pricing, products, models, methods, procedures, frameworks, software, code, intellectual property, technologies, descriptions, documents and content is strictly for potential and existing customers and is strictly prohibited for (potential) competitors of our services.
3. It is illegal and strictly forbidden to copy, publish, print, redesign, re-engineer, disclose, translate, share, re-package, alter, cache servers, websites, content including but not limited to information, pricing, products, models, methods, procedures, frameworks, software, code, intellectual property, technologies, descriptions, documents and content in whole or portions found on our website(s) or server(s) without prior written consent from The Cool Mediators Foundation (Stichting Cool Mediators), unless explicitly indicated by means of a public license.



Privacy

In order to have access to all interactive programming tools of the Cool Mediators discussion platform, as well as for participation in live events, you are required to register yourself and submit your e-mail address. No other private data of yours is required. You can register and use your real name and/or your nickname. This information will not be accessible to other users or any third party.

Both this and any other personal information about yourself that you would like to communicate voluntarily to others by creating your own participant profile, will not be subjected to any further dissemination by us. However, since the participants profiles (but NOT registration information) are meant to be openly accessible for other visitors of the web site, we cannot guarantee prevention of unauthorized use of personal data represented in your profile by third parties. Therefore, please make your own decision which information about yourself you would like to be publicly accessible in your participant profile, and beware of possibility of potential misuse.

Warranty Disclaimer and Limitation on Liability

- COOL MEDIATORS BE NOT LIABLE TO USERS AND THIRD PARTIES FOR ANY DAMAGES RISING OUT OF OR IN CONNECTION WITH USE OF COOL MEDIATORS PLATFORM, SITE, EMBEDDED WIDGET, SERVICES, CONTENTS AND USER SUBMISSIONS.

- COOL MEDIATORS BE NOT LIABLE FOR THE ACTIONS OF USERS OF ITS SERVICES SHOULD INFRINGEMENT OF OWNERSHIP, COPYRIGHT AND OTHER INTELLECTUAL PROPERTY RIGHTS OCCUR AS RESULT OF USERS ACTIONS.

- COOL MEDIATORS BE NOT LIABLE TO USERS FOR ACTIONS AND CONTENT OF THIRD PARTIES WHOSE CONTENT AS WELL AS LINKS TO WEB SITES OF WHICH ARE REPRESENTED ON COOL MEDIATORS WEB SITE, EMBEDDED WIDGET AND OTHER MATERIALS AUTHORIZED BY COOL MEDIATORS.

- COOL MEDIATORS RESERVE THE RIGHT BUT IS NOT OBLIGED TO REVIEW, EDIT, DELETE OR BLOCK A USER’S CONTENT IN CASE IF SUCH CONTENT VIOLATES RULES OF CONDUCT DECLARED ON COOL MEDIATORS WEB SITE, THE LAW OR THE TERMS OF USE.



Applicable law / authorized court

- These Terms & Conditions will be governed by Dutch law.
- Dutch law is applicable to all legal relationships between Cool Mediators and the user.
- Any legal issues that might arise from these agreements or agreements derived from these agreements, will be settled in Dutch court. The procedure will be conducted in the Dutch language.
